Tout en marchant ensemble dans Central Park, Sam demanda Marilyn ce qu'elle apprenait à l'Actors Studio. Quand elle a répondu: «Improvisation», il lui demanda de lui montrer. Marilyn attrapa le journal de Sam et se dirigea vers un banc à lire. Plus tard, elle expliqua l'intense conversation du couple. A côté d'elle, l'homme demanda à la femme de se marier avec lui. Elle a dit qu'elle le ferait, mais à la condition qu'il renonce à sa vie de bookmaker.

Comme le titre l'indique, ce livre compile les photographies de Marilyn Monroe prises lors de ses années new-yorkaises par Sam Shaw. Mais pas vraiment en fait, puisqu'on y retrouve aussi les clichés pris avec Arthur Miller sur la plage de Long Island et dans la prairie du Connecticut; en fait, le livre aurait du plutôt s'appeler "Les années sur la Côte Est". C'est un beau livre de photographies, néanmoins quelques reproches sont à exprimer:
- du point de vue de la forme du livre: des clichés tronqués, parfois en petit format sur une page (laissant un grand espace vide), parfois en grand format sur une double page; Shaw a pris de superbes clichés de Marilyn et il est un peu malheureux de découvrir que son travail n'est ici pas vraiment mis en valeur.
- du point de vue du fond: très peu d'écrit; le livre se concentre surtout sur les photos certes (et pas forcément publiées en ordre chronologique: son arrivée à New York en septembre 1954 est publiée entre la série en robe blanche dans la ville en 1957 -cf couverture du livre- et la première du "Prince et la danseuse" en 1957), mais il aurait été judicieux d'y apposer un simple paragraphe permettant de contextualiser les images. Quelques citations de Marilyn et de Shaw jonchent le livre, mais on reste véritablement sur sa faim. Une explication sur les raisons qui ont poussé Marilyn à s'installer à New York auraient été appréciée ne serait-ce pour les "non fans" de Marilyn qui ne connaissent pas sa vie sur le bout de doigts. De même, son amitié durable avec le photographe aurait pu être explicité.
En bref: c'est un livre à réserver pour les fans, qui complèteront leur collection bibliographique. Je ne le conseille pas pour ceux et celles qui veulent découvrir Marilyn au vue du manque d'information.

A federal court in New York has rejected the claim of Marilyn Monroe’s estate that it owns rights of publicity in the actress’s likenesses, including photographs. In addition to undercutting a lawsuit against a photo archive for unauthorized commercial use of a Monroe photograph, the decision opens the door for anyone to use Monroe images commercially without permission from the estate.
The estate, MMLLC, and its licensing agency, CMG Worldwide, sued the Shaw Family Archives and its agent, Bradford Licensing Associates in 2005. The suit alleged commercial use of Marilyn Monroe’s likeness without permission, in violation of Indiana’s right of publicity law. Among the alleged violations was a t-shirt, purchased at an Indiana Target store, bearing an image of Monroe credited to the Shaw Family Archives.
For years, MMLLC has collected fees for commercial use of Monroe’s likeness, on the grounds that it owns Monroe’s rights of publicity. Those commercial licensing fees are separate from (and in addition to) usage fees that licensees pay to the copyright holders of the images.
The Shaw Family Archives, owned and operated by the three children of the late Monroe photographer Sam Shaw, responded to MMLLC’s lawsuit by challenging the validity of the estate’s right-of-publicity claims.
MMLLC argued that it had controlling interest in Monroe’s rights of publicity because of a transfer clause in the actress’s will. But SAF argued that Monroe couldn’t pass those rights along in her will, because they were non-existent at the time of her death.
The federal court in New York agreed.
So-called postmortem (or after death) rights of publicity exist by law in some states but not others. The Indiana law didn’t apply, the court ruled, because Monroe never lived there, and because the Indiana law was enacted in 1994—long after Monroe’s death in 1962.

It is a matter of debate whether Monroe was a resident of New York or California at the time of her death in 1962. But California didn’t enact a postmortem right of publicity law until 1984, and New York still doesn’t have one. Since neither of those states had rights of publicity laws on the books at the time of Monroe’s death, the court ruled, she never had any publicity rights to pass on to heirs or beneficiaries.
“Any publicity laws she enjoyed during her lifetime were extinguished at her death by operation of law,” the judge wrote in her decision. MMLLC argued that the Indiana law conferred publicity rights after Monroe’s death, but the judge dismissed that argument as “untenable.”
“We’re beside ourselves…this is a big boost, because a lot of people wouldn’t do [business] with us before,” says Meta Shaw Stevens, who owns Shaw Family Archives with her sister Edith Shaw Marcus and her brother Larry Shaw. She explains that “in the past, [our clients] had to pay a tremendous amount of money to CMG, which left very little money for photos. Now companies can come to us, and they don’t have to pay CMG.”
Through spokesperson Michael Nagel, CMG declined to comment about the ruling. It is unknown whether the company will appeal
According to Christopher Serbagi, who represented SFA along with Sam Shaw’s grandson David Marcus, CMG lobbied for the enactment of Indiana’s right of publicity law, hoping to bestow rights of publicity on celebrities and their heirs no matter where they lived (CMG represents various celebrities and celebrity estates).
“[MMLLC and CMG] took a big risk and lost” in deciding to test the Indiana law and their right of publicity claims, says Serbagi.
Users of Monroe images usually capitulate to CMG’s demands, rather than take on the cost and risk of a legal battle, Serbagi says.
But the Shaw family decided to fight, Meta Stevens says, because “we didn’t have very much to lose. If we had lost, we would have been where we were.” Most of the legal work, she says, was done by her nephew, David Marcus.
“It’s the David and Goliath story. My nephew worked feverishly on behalf of his grandfather and other photographers in a similar situation. He’s a one man operation up against a mega law firm, and something good happened.”
Serbagi says SFA is now pursuing its counter-claims against CMG. “We intend to vigorously pursue them for interfering with our business relationships, and for causing us financial damage,” he says.

A federal judge in Manhattan has sided with the family of late photographer Sam Shaw in a dispute over the rights to images of Marilyn Monroe.
Southern District of New York Judge Colleen McMahon rejected a claim that the estate of Shaw had violated Monroe's right of publicity by selling photos without the consent of Marilyn Monroe LLC, a company founded by the Hollywood icon's heirs.
The judge, writing in Shaw Family Archives Ltd. v. CMG Worldwide, Inc., 05-CV-3939, said the laws of New York, California and Indiana, which were at the heart of the dispute, did not grant a retroactive right of publicity to Monroe after her death.
"Ms. Monroe could not devise by will a property right she did not own at the time of her death in 1962," the judge wrote.
The ruling is the first of its kind involving the image of the legendary sex symbol. The attorneys who represent the Shaw estate, David M. Marcus and Christopher Serbagi, said "tens of millions" of dollars are at stake because of the ruling. They will pursue counterclaims against Monroe's heirs for interfering with licensing relationships.
Orin Snyder of Gibson, Dunn & Crutcher, which represents Marilyn Monroe LLC and its licensing company, CMG Worldwide, said his clients were considering an appeal.
Shaw, who died in 1999, took some of the most famous pictures of Monroe, including several of her standing over a subway grate for the 1955 film "The Seven Year Itch."
Monroe's will left most of her estate to Lee Strasberg, the acclaimed director and producer, and a teacher of Monroe's. Strasberg in turn made his wife, Anna, the sole beneficiary of his will.
At the time of Monroe's death she was either a resident of New York or California, neither of which recognized descendible postmortem publicity rights at the time.
But Strasberg's licensing company alleged that a subsequent California statute granting a postmortem right of publicity, passed in 1984, applied to Monroe.
The company also contended that a T-shirt sold at a Target in Indiana last year violated Indiana's Right of Publicity Act, which was passed in 1994. The law creates a descendible and freely transferable right of publicity for 100 years after death. The statute claims to apply to any act or event that occurs in the state, regardless of a person's domicile.
Judge McMahon rejected these claims in an 18-page opinion issued Wednesday. She said it was impossible for Monroe's will to recognize future rights that did not exist at the time of her death and pass them along to her heirs.
"At the time of her death in 1962 Ms. Monroe did not have any postmortem right of publicity under the law of any relevant state," Judge McMahon wrote. "As a result, any publicity rights she enjoyed during her lifetime were extinguished at her death by operation of law."
The judge did not accept the claim that language of Monroe's will, which cited all property "to which [she] shall be in any way entitled," could apply to publicity rights created 22 years later.
"In the absence of any other evidence concerning Ms. Monroe's intent, this boilerplate language is much too slender a reed on which to hang a devise of postmortem publicity rights that did not come into being until 22 years after her death," the judge wrote.
